Terms and Conditions

Entrepreneurial Scotland welcomes you to The Summit website. Please find below our terms and conditions for use of the website, which you may access in several ways, including but not limited to the World Wide Web and RSS feeds. These terms and conditions apply whenever you access the website, on whatever device.

By using the website, you are deemed to have accepted these conditions. Any changes we make to the terms and conditions will be reflected on this page.

All entries will be shared with Entrepreneurial Scotland for publicity and promotional activity about the awards. We will always contact the nominee before publication to ensure they are happy with what we have planned.

1. Contacting the nominator and nominee

It is assumed that by submission of a nomination to the Summit Awards, Entrepreneurial Scotland and partners involved in the judging process will have consent to contact both the nominator (for further information where appropriate) and the nominee (for information relating to their nomination. Entrepreneurial Scotland also reserve the right to contact nominees for marketing purposes. If you do not wish to be contacted for marketing purposes, please opt out by emailing

Entries into the Summit Awards are confidential unless selected by the judges as a shortlisted candidate in which case the nominee and their business will be announced on the website.

2. Use of data for marketing materials

By entering the awards, entrants understand that the information they provide about the nominated company (excluding turnover and pre-tax profit information which will remain confidential at all time) may be used by the Entrepreneurial Scotland and STV for marketing purposes at any time in the future. We will get in touch with the relevant entrant to make sure they are happy for us to use the data we retain on file.

Entries into the Summit Awards is confidential unless you are selected, by the judges, as a shortlisted candidate in which case the nominee and their business will be announced on the website.

3. Collation/Sharing and storing of data

The entries will be shared with Deloitte and other partners for judging purposes depending on the category in which it has been entered. Anonymous data collated from all the entries (i.e. the total number in each category or where nominations have come from) might be shared with partners who are helping to promote the awards to thank them for their help.

Entry information will be kept for up to three years. We will use this information to contact you about the Awards, tickets and promotion and future opportunities about the awards.

4. Photography/Videography and Case Studies from the Summit Awards

By submission of a nomination to the Summit Awards, each participant agrees to be bound by the official award rules.

We reserve the right to request video/photograph and Case Studies from nominees and that this material can be used in the following ways:

  1. Use on The Summit Awards Website
  2. Use on The Entrepreneurial Scotland Website and other relevant mediums
  3. Use on The STV website and other relevant mediums

5. Rules and conditions of entry

Location: Nominations into the awards need to be from a business with their headquarters in Scotland. Nominees must also be based in Scotland.

Number of entries: Nominators can enter multiple categories if the nomination is relevant.Deadline: All entries must be received by 16 August 2018 at Midday.

  1. Entrants must be able to support their nominations with audited financial information if requested by the judges.
  2. If shortlisted, nominees must be available to meet and be interviewed by a judging panel in October/November.
  3. The organisers reserve the right to publish information about the winners and runners up.
  4. The judges’ decisions will be final.
  5. Entrants to the Pocket Money Entrepreneur of the year award category must be aged 12-18.


6. STV and Entrepreneurial Scotland and the nominations process

  • STV staff reserve the right to nominate candidates for the awards as they are not part of the judging process.
  • Entrepreneurial Scotland staff reserve the right to nominate candidates for the awards as they are not part of the judging process except for the Rising Star category where they will act in a judging capacity.

7. Moving categories

In the event we find a nomination is more suited in a different category than has been entered, we reserve the right to move the nomination accordingly.

8. Withdrawal or Termination of a nomination

I) Withdrawing a nomination

You have the right to remove your entry at any point in time. Please email and we’ll do this for you.

ii) Termination of a nomination

If we wish to bring the agreement to an end, we will do so by emailing you at the address you have registered stating that the agreement has terminated. The agreement will terminate, and your application will be terminated.

9. Use of material appearing on The Summit Awards website

You must except by express consent of the data controller reproduce any part of The Summit Awards website or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form unless we have indicated that you may do so.

10. Disclaimer of liability

To the extent permitted at law, we do not accept any responsibility for any statement in the material. You must not rely on any statement we have published on The Summit
Awards website without first taking specialist professional advice. Nothing in the material is provided for any specific purpose or at the request of any person.

For the avoidance of confusion, we will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading or listening to the material or any part of it (except for death or personal injury attributable to our negligence and to the extent permitted at law).

There are links on The Summit Awards website to third party web sites which Entrepreneurial Scotland and STV has no control over. Entrepreneurial Scotland accepts no responsibility or liability for any third-party practices on third party websites.

We give no warranties of any kind concerning The Summit Awards website or the material. We do not warrant that The Summit Awards website or any of its contents is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.

11. Third party material on The Summit Awards website

You may see advertising material submitted by third parties on The Summit Awards website. Individual advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. We accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein.

12. Submitting text for publication on The Summit Awards website

If you want to submit material to us for publication on The Summit Awards website, you may do so on the following terms and conditions:

  • (I) Publication of any material you submit to us will be at the sole discretion of Entrepreneurial Scotland. We reserve the right to make additions or deletions to the text or graphics prior to publication, or to refuse publication.
  • (Ii) You warrant to us that any material you submit to us is your own original work and that you own the copyright and any other relevant rights.
  • (Iii) You warrant that the material you submit is not obscene, offensive, defamatory of any person or otherwise illegal.

(Iv) You acknowledge that any breach of these warranties may cause us damage or loss and you agree to indemnify us in full and permanently against any third-party liabilities, claims, costs, loss or damage we incur as a result of publishing material you submit to us, including consequential losses.

13. Variations

These terms may be varied from time to time. Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the site after it has been posted.

14. Force majeure

Although we will do our best to provide constant, uninterrupted access to The Summit Awards website, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.

15 Governing Law & Jurisdiction

This agreement is governed by Scottish Law and the parties agree to submit to the exclusive jurisdiction of the Scottish Courts.

16. Conduct of nominated organisations

The Summit Awards are organised by Entrepreneurial Scotland and STV and businesses showing innovation, success and ethics. Therefore, and in line with our principles, should a company be found to behave in an illegal, unethical or fraudulent manner the Entrepreneurial Scotland and STV reserves the right to revoke the company’s status in the awards process and including status from previous years. If this occurs we will contact the company in question to inform them of our decision, they will be removed from our website and will not be allowed to use their status logos on any of their company material.

17. Purchasing tickets

Finalists will receive a complimentary ticket to the Summit Awards evening on 22th November, all other tickets will be purchasable from the Summit Website.

We will only accept cancellations up to 30 days prior to the event and a full refund will be given. No refunds will be given to cancellations within 30 days of the event taking place.
